Terms and Conditions
1. About Us
1.1 The website at www.biosupply.com.au (Website) is operated by Simple Supply Pty Ltd ABN 48 641 071 678 trading as Bio Supply (we, us, our).
1.2 We manufacture and/or supply custom-printed hospitality packaging including cups, greaseproof paper and coasters, and related services (Products).

2. Acceptance of Terms
2.1 By accessing the Website, placing an order, or using our online designer tool, you agree to these Terms & Conditions (Terms).
2.2 If you do not agree, you must not use the Website or purchase Products.
2.3 We may update these Terms at any time by posting the new version on the Website. The updated Terms apply from the date of posting.
3. Accounts
3.1 You may need an account to purchase Products or access a customer portal. You are responsible for safeguarding your login credentials and for all activity under your account.
3.2 You must provide accurate, current and complete information and keep it up to date.
4. Quotes, Orders & Contracts
4.1 Quotes. Written quotes are valid for 7 days unless stated otherwise. A quote is not a commitment to supply until you approve the artwork (if applicable) and make payment.
4.2 Orders. An order is accepted when we issue an order confirmation or commence production. We may decline an order (for example, if materials are unavailable or artwork is unsuitable) and will refund any payment received for declined orders.
4.3 Third-party production. We may fulfil orders using trusted manufacturing partners. Our obligations to you are unchanged.
5. Artwork, Online Designer Tool, Proofing & Approvals
5.1 Supplying artwork. Provide print-ready vector files (PDF/EPS/AI) with fonts outlined and images at 300 DPI minimum. If you cannot provide print-ready files, we can assist with artwork preparation or tracing at our current rates.
5.2 Online designer tool. Our Website provides a custom design tool for you to create and position your own artwork. Designs created using this tool are treated as final submissions once approved at checkout. You are solely responsible for reviewing layout, text, images, spacing, scale, bleed/safe zones, and any other design elements before proceeding. We do not accept responsibility for errors, omissions, or unexpected outcomes arising from the use of the online designer tool.
5.3 Proofs. For orders placed outside the online designer tool, we will provide a digital proof (or cup mock-up) for your review. Carefully check all details (layout, colours, size, spelling, placement). Your written approval is required before production.
5.4 Revisions. Unless stated otherwise, one round of minor revisions is included. Additional revisions may incur charges.
5.5 Accuracy & risk. You are responsible for the accuracy of the approved proof and/or the final design submitted via the online designer tool. We are not liable for differences between the proof/designer preview and the printed outcome, as stock types absorb and reflect ink differently and colours may shift once printed. By approving or submitting your design, you accept this risk.
6. Colour, Inks, Materials & Print Tolerances
6.1 CMYK only. We print strictly in CMYK process colour. We do not print with Pantone®/PMS spot inks. If you submit artwork containing Pantone colours, these will be converted to CMYK. You accept full responsibility for the resulting colour variation compared to the Pantone reference.
6.2 Digital vs print. Colours displayed on screens, digital proofs, or within the online designer preview will not exactly match the final printed result. Stock textures, coatings, and paper whiteness cause inks to absorb and reflect differently. Final outcomes may vary from your expectations, and we are not responsible for these variations.
6.3 Pantone references. Exact Pantone® matches cannot be guaranteed. Pantone C (coated) references in particular will not replicate accurately on uncoated stocks. Where possible, we will approximate using Pantone U or CMYK breakdowns, but responsibility for colour variation rests with you.
6.4 Variations. Minor variations in colour, registration, density and image position are inherent to print manufacturing. A commercial tolerance of ±5% in colour variation and ±1.5 mm in placement applies.
6.5 Materials. Paper textures, whiteness and finishes can vary slightly between batches and suppliers.
7. Quantities (Overs/Unders)
7.1 For custom print runs, a manufacturing tolerance of ±10% on quantity may apply. We will invoice the actual shipped quantity where the variance is within tolerance.
7.2 If you require an exact quantity, please tell us in advance—extra charges may apply and lead times may change.
8. Pricing, Currency & GST
8.1 Prices are in AUD and, unless stated otherwise, exclude GST and shipping.
8.2 We may change prices at any time before you place an order.
8.3 Obvious pricing errors may be corrected, and we may cancel an affected order with a full refund.
9. Payment & Invoicing
9.1 Up-front payment. Unless we agree otherwise in writing, full payment is required at checkout or before production starts.
9.2 Payment methods. We accept the payment methods shown at checkout, which may include credit/debit cards and PayPal.
9.3 Invoices. Where applicable, invoices are issued via Zoho Books. If you place an order through our ecommerce system, a paid invoice will be created upon successful checkout.
9.4 Late or failed payment. We may pause production or delivery until payment is received in full.
10. Lead Times, Shipping & Delivery
10.1 Lead times. Lead times shown on the Website are estimates and start from artwork approval and receipt of payment. Rush options may be available on request.
10.2 Shipping. We ship Australia-wide via third-party carriers (e.g. StarTrack, Aramex, TNT and other couriers). Shipping costs are calculated at checkout or quoted separately.
10.3 Risk & title. Title passes on full payment. Risk in the Products passes to you on dispatch to the carrier or on collection.
10.4 Delivery issues. If a carrier’s Proof of Delivery (POD) confirms delivery to the specified address, we will treat the order as delivered. If you cannot locate the goods, contact us promptly so we can help liaise with the carrier.
11. Inspection, Claims & Reprints
11.1 Inspect promptly. Please inspect your order on delivery. To help us resolve issues, notify us within 3 business days of delivery of any shortages, transit damage or defects.
11.2 Evidence. We may request photos, samples and batch codes to assess a claim.
11.3 Remedies. If we agree a Product is faulty or not as described, we will (at our option) reprint, replace or refund the affected items.
11.4 Custom goods. Because Products are custom-made, change-of-mind returns are not accepted.
11.5 Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
12. Cancellations
12.1 You may cancel an order before proof approval and production. We will refund minus any reasonable artwork or admin costs incurred.
12.2 After proof approval or once production has commenced, cancellations are not possible.
13. Intellectual Property & Usage Rights
13.1 Your artwork. You warrant that you own, or have permission to use, all artwork, logos and content you provide and that our use will not infringe any third-party rights. You grant us a non-exclusive licence to use such materials solely to produce your order.
13.2 Our IP. All Website content, templates, dielines, photography and branding (excluding your artwork) are our intellectual property or that of our licensors. You must not reproduce them without permission.
13.3 Portfolio samples. We may display anonymised production photos and retain a small number of samples for quality and marketing purposes. If you prefer we do not display your brand, email info@biosupply.com.au and we will honour your request.
14. Website Use & Acceptable Use
14.1 You must not misuse the Website, including by attempting unauthorised access, scraping, data mining, introducing malware or interfering with the security or operation of the Website.
14.2 We do not guarantee the Website will be error-free or available at all times. We may suspend access for maintenance or security reasons.
15. Regulatory Compliance & Customer Responsibility
15.1 Single-use plastic restrictions. Laws regarding single-use plastics vary across Australian states and territories. These regulations may affect the legality of certain cups, lids, or other products supplied by us.
15.2 Customer responsibility. We cannot control or monitor where or how you use our Products once delivered. You are solely responsible for ensuring that the Products you purchase and use comply with the laws and regulations of the jurisdiction in which they are supplied or consumed.
15.3 No liability. We are not liable for any fines, penalties, enforcement actions, or losses resulting from your purchase or use of Products in jurisdictions where such Products are restricted or prohibited.
15.4 Information provided. We may, at our discretion, provide general reference information regarding single-use plastic restrictions. Such information is provided for convenience only, may not be complete or current, and does not constitute legal advice. Customers must conduct their own research and obtain independent advice to confirm compliance.
16. Warranties, Liability & Indemnity
16.1 Except for non-excludable guarantees under the Australian Consumer Law, the Website and Products are provided “as is” and we exclude all implied warranties.
16.2 To the maximum extent permitted by law, our liability for any claim relating to the Products or these Terms is limited to the amount paid for the affected Products or re-supply of the Products.
16.3 We are not liable for indirect or consequential loss, loss of profit, loss of business or production delays caused by events beyond our reasonable control (including carrier delays, supply chain disruptions or force majeure).
16.4 You agree to indemnify us against losses arising from your breach of these Terms or infringement of third-party rights in materials you supply.
16.5 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or other liability that cannot be excluded by law.
17. Privacy
17.1 We handle personal information in accordance with our Privacy Policy. By using the Website, you consent to that handling.
17.2 We use third-party providers (including payment processors and logistics partners). Your information may be shared with them to fulfil your order.
18. GST & Taxes
18.1 Unless stated otherwise, prices are exclusive of GST. GST and any applicable duties or charges will be added at checkout or on the invoice.
19. Force Majeure
19.1 We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, industrial disputes, epidemic, government action, or transport/supply interruptions.
20. Severability & Waiver
20.1 If any provision of these Terms is held invalid, the remainder remains in effect. Failure to enforce a right does not constitute a waiver.
21. Governing Law
21.1 These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
